Aggie Surplus Sales Terms and Conditions:

Purchaser accepts the purchased property AS IS, and purchaser acknowledges that no warranties, express or implied, were made by the University of California Aggie Surplus or its representatives. Purchaser, on behalf of itself, its hires, assigns, and successors, agrees as follows:

1. University warrants it is the lawful owner of the property and has the right to convey title thereto.

2. The Property is being sold on an "as is" basis, and ALL SALES ARE FINAL. THERE ARE NO WARRANTIES (EXPRESS OR IMPLIED), ADJUSTMENTS, REPAIRS, REFUNDS, OR EXCHANGES. EXCEPT AS SPECIFICALLY NOTED, ALL SMOG CERTIFICATIONS AND ALL SMOG RELATED REPAIRS ARE THE SOLE RESPONSIBILITY OF THE PURCHASER.

3. Purchaser assumes the entire risk as to the quality and performance of the property.

4. Title to all property passes to the Purchaser upon payment therefore. If University, at Purchaser's request, assists Purchaser in moving the property, Purchaser will hold University harmless from any loss or damage caused by any acts or omissions of University. The foregoing to the contrary notwithstanding, Purchaser bears the risk of loss or damage to the purchased property. Should the property prove defective in any respect following its purchase, the Purchaser, and not the University of California or its representatives, assumes the entire cost of all necessary servicing or repair.

5. The Purchaser, by purchasing the property on an "as is" basis, hereby waives any claim against the University of California and its representatives regarding the quality or performance of the property purchased, and Purchaser agrees to hold the University of California free and harmless for any loss, cost, expense, or claim arising in connection with the property subsequent to the purchase and to indemnify the University there from.

6. PURCHASER IS OBLIGATED TO PICK UP PURCHASED PROPERTY WITHIN FIVE (5) BUSINESS DAYS OF THE SALE TRANSACTION. YOU WILL RECEIVE AN EMAIL WITHIN 1 BUSINESS DAY OF PURCHASE TO SCHEDULE AN APPOINTMENT TO PICK-UP. IF THE ABOVE-DESCRIBED PROPERTY IS NOT PICKED UP OR ALTERNATIVE ARRANGEMENTS MADE TO UNIVERSITY'S SATISFACTION WITHIN A FIVE (5) BUSINESS DAYS, AGGIE SURPLUS SHALL HAVE THE RIGHT TO CANCEL THIS AGREEMENT, RESTOCK THE ABOVE-DESCRIBED PROPERTY, AND CHARGE THE PURCHASER A SERVICE CHARGE EQUAL TO 15% OF THE PURCHASE PRICE OF SAID PROPERTY OR $5.00, WHICHEVER IS GREATER.

7. University policy prohibits the purchase of University property, either directly or through public sale, by an employee of the department releasing the property; by an employee of a Distribution Services department; in the sale of a University owned motor vehicle, by its principal driver; or by a near relative of any such employee. (A near relative is defined as a spouse, parent, child or sibling of the employee, and in-laws and step-relatives in those same relationships.)

8. The Purchaser attests that they are the person named above and they are not buying on behalf of an individual described in number 7 above.
